WHAT TO EXPECT WHEN YOU COME IN FOR YOUR FREE PERSONAL INJURY COUSULTATION
Most people are intimidated when they consult with an attorney, especially if they have never met with an attorney before. At the Law Offices of **********, we do our best to make you feel at ease.
Once you schedule an appointment with our office, we will provide you with easy directions if you need them. We will also request that you provide us with any medical records that you possess (particularly medical records that indicate that your injury is accident-related), your insurance information, and any information that you have received from the insurance company that insures the person, business or entity that was responsible for your accident.
When you first come in for your free appointment, we will provide you with paperwork to fill out, as a physician would, so that we can better apprise you of your legal rights. This sheet will provide us with personal information so that we can maintain contact with you in the event we accept your case.
Once you complete the above paperwork, we will meet with you to explain your rights pursuant to Colorado law. We will discuss any benefits you may be entitled to for payment of your medical bills pursuant to the medical-benefit portion of your automobile insurance policy or a medical-payment portion of the business policy of the person who is at fault for your accident.
We will also explain how there are two parts to a personal injury liability case in Colorado : the liability aspect of your case, and the damages aspect of your case. We will further explain the difference between special or out-of-pocket damages as opposed to general damages or damages that are awarded for pain and suffering.
In the event, that we accept your case, we will ask you to complete a limited power of attorney to safeguard any funds we receive on your behalf as well as releases to obtain the necessary paperwork from medical providers, employers, schools and any other entity that has been involved in your wage loss or pain and suffering.
We will also discuss with you all the medical treatment that you have received, and advise you on how this treatment affects the amount of money a claims adjuster is willing to offer you or a jury is willing to award you.
If you are married, and your spouse has been affected by this incident, we will review with him or her a loss of consortium claim. This is loss of sex, society, and companionship due to the injured person's medical or psychological condition. This claim is separate and distinct from your claim.
If the person who was injured ultimately dies, we will meet with that person's relatives and explain the rights of each dependent. As above, this will depend on the liability of the decedent's accident or incident.
Finally, we will make a commitment to you to communicate. It is the goal of our office to return phone calls within 24 (twenty-four) hours, and to do our best to always return them within 48 (forty-eight) hours. We look forward to meeting with you.
